A Stanislaus County jury has convicted a Turlock man for rape after he broke into an apartment and sexually assaulting the victim, the Stanislaus County District Attorney’s Office reported.

Ivan Garcia Jr., 26, of Turlock was found guilty of forcible rape for the June 13, 2020 attack.

Garcia broke into an apartment in the 900 block of W. Monte Vista and assaulted the victim, who had been asleep in a bedroom. The victim and Garcia were not known to each other, a fact Garcia admitted when he took the stand.

Garcia “did not take any measures to conceal his identity. The victim was able to identify him in a photographic line-up,” said Asst. Deputy District Attorney Dannica Molina, who prosecuted this case.

Detectives with the Turlock Police Department were also able to connect Garcia to the rape with DNA evidence.

Garcia is set to be sentenced on Sept. 4. He is facing a maximum prison term of eight years. In California, people convicted of this crime can be sentenced to three, six or eight years. The defendant will have to register as a sex offender for the rest of his life.

The trial lasted five days and the jury returned the guilty verdict in about 25 minutes.

The District Attorney’s Victim Services Unit provided assistance to the victim. The California Department of Justice conducted forensic and DNA testing in support of the investigation.
